That's not always true. A copyright holder or their heirs can apply for an extension to the copyright (disney, winnie the pooh, all examples). you should check with the copyright office (
www.copyright.gov) and either do a check yourself or have them do one. you should also check with the original author and/or their heirs.

Tangentially, you bring up the interesting policy of the LOC of not (officially) saving the results of their searches so that there is no catalog of public domain works.
I've been told by a friend who does copyright clearance work at LOC that the staff does keep unofficial records to save themselves the work of having to look things up more than once. They do still charge you the full amount for the search.
Anyway, not having a catalog of public domain works makes the IA's job much harder as they will have to do the research themselves. And only paper records before '76? I think Brewster makes an understatement when he says
I think this shows how little the LOC values our public domain.
